In these Terms, “Summit”, “Summit Gym”, “we”, “us” and “our” refer to UNIT 3 ELLESMERE BUSINESS PARK LTD. “Member”, “you” and “your” refer to the person purchasing or using a membership.
ACCEPTANCE OF THESE TERMS
By purchasing a Summit Gym membership, you confirm that:
a. you have read and accepted these Terms and Conditions;
b. the information you provide is complete and accurate;
c. you are at least 18 years old;
d. you agree to complete the required Physical Activity Readiness Questionnaire (“PAR-Q”) before using the gym or participating in a class; and
e. you agree to follow Summit’s health, safety, access and conduct rules.
Your membership is personal to you and cannot be transferred, sold, lent or shared with another person.
MEMBERSHIP OPTIONS
Our current standard monthly memberships are:
a. Gym Membership – £25 per month;
b. Classes Membership – £60 per month; and
c. Gym and Classes Membership – £80 per month.
The services included in each membership will be explained in the app, on our website or during the sign-up process.
Memberships do not include personal training, individual coaching, day passes or other services unless expressly stated.
INITIAL MEMBERSHIP TERM
All memberships have an initial minimum commitment of three months.
After the initial three-month commitment, the membership will continue on a monthly rolling basis until it is cancelled in accordance with section 8.
A member may provide cancellation notice during the initial commitment. However, the membership cannot end before the three-month minimum commitment has been completed. Notice given at least one month before the end of the initial term may take effect at the end of that initial term.
PAYMENTS
Membership fees are collected monthly by Direct Debit.
Regular monthly payments will normally be collected on the first working day of each month.
When joining partway through a month, the amount payable and the first collection date will be displayed or explained before the membership is confirmed.
You must ensure that valid payment details are maintained and that sufficient funds are available.
If a payment fails, we or our payment provider may retry the collection and contact you to arrange payment. Gym access and class-booking privileges may be temporarily suspended while an amount remains overdue.
Any failed-payment fee will only be applied if it has been clearly disclosed in advance and reflects reasonable costs incurred.
Cancelling a Direct Debit through your bank does not automatically cancel your membership. You must also provide cancellation notice through the Summit app or by emailing [email protected].
MEMBERSHIP PRICES
The price applicable when you join will remain unchanged while you continuously retain the same membership.
If you cancel your membership and later rejoin, the prices available at the time you rejoin will apply.
If you change to a different membership, the current price of the new membership may apply.
This does not prevent us from changing prices for optional services or introducing new services, provided any relevant price is clearly displayed before purchase.
Your statutory consumer rights are not affected.
CANCELLING YOUR MEMBERSHIP
After or in anticipation of completing the initial three-month commitment, you may cancel your membership by giving at least one month’s notice.
Cancellation requests must be submitted:
a. through the Summit app; or
b. by email to [email protected].
Your membership, access and payment obligations will continue during the notice period.
We will confirm your cancellation and final membership date. You should contact us if you do not receive confirmation within a reasonable period.
Memberships cannot currently be frozen or paused.
We will consider reasonable requests for early cancellation where exceptional circumstances prevent continued use, such as a serious long-term medical condition, injury, pregnancy, redundancy or permanent relocation. We may request reasonable supporting evidence. Any decision will be made fairly, taking account of the circumstances and applicable consumer law.
GYM ACCESS
Summit Gym operates with 24-hour member access, subject to maintenance, emergencies, safety restrictions and temporary closures.
The gym will not always be staffed. Members must decide whether they are comfortable training without staff supervision.
Members will receive an individual access code or other access credential. Access details:
a. are personal to the member;
b. must be kept secure;
c. must not be shared with another person; and
d. must not be used to allow a non-member into the premises.
We may deactivate access credentials if we reasonably suspect that they have been shared or misused.
Members must not allow another person to “tailgate” into the gym.
We may limit access temporarily if the gym reaches its safe capacity.
AGE AND CHILDREN
Membership and access are currently restricted to people aged 18 or over.
Children and people under 18 must not enter or use the gym unless Summit introduces a specific supervised service and confirms permission in writing.
These rules may be updated if our insurance and safeguarding arrangements change.
CLASSES AND BOOKINGS
Classes may be booked up to four weeks in advance through the Summit app or website.
All bookings are subject to availability and class capacity. A waiting list may operate when a class is full.
A place is not guaranteed until the booking has been confirmed.
Members must cancel a class at least 24 hours before its scheduled start time.
A cancellation made less than 24 hours before a class, or failure to attend a booked class, will result in one strike.
Three strikes within a rolling three-month period will result in a two-week suspension from booking classes.
We may remove a booking if the membership is suspended, cancelled or unpaid.
Members arriving more than 15 minutes after a class has started may be refused entry for safety reasons. This may be treated as a late cancellation or non-attendance.
CLASS CHANGES AND CANCELLATIONS
We may make reasonable changes to:
a. class times;
b. instructors;
c. class formats;
d. class locations within the premises;
e. capacity limits; and
f. the timetable.
Classes may occasionally be cancelled because of instructor illness, emergencies, maintenance or circumstances outside our reasonable control.
Where reasonably possible, we will provide notice through the app, email, text message or another suitable communication method.
A timetable change or the cancellation of an individual class does not automatically entitle a member to cancel the whole membership or receive a refund. This does not affect your legal rights where there is a significant or ongoing change to the service.
HEALTH AND PAR-Q REQUIREMENTS
Every member must complete the required PAR-Q before using the gym or attending a class.
You must provide accurate information and disclose relevant injuries, medical conditions, pregnancy or other circumstances that may affect your ability to exercise safely.
You are responsible for updating Summit if your health circumstances change.
Completing a PAR-Q does not replace professional medical advice. You are responsible for seeking medical clearance where appropriate, particularly if you:
a. have been advised not to exercise;
b. have a medical condition affected by exercise;
c. are pregnant or have recently given birth;
d. are recovering from an injury or operation; or
e. experience chest pain, dizziness, unusual shortness of breath or another concerning symptom.
You must stop exercising and seek appropriate assistance if you feel unwell or experience pain or concerning symptoms.
INDUCTIONS AND SAFE USE
An induction may be offered, but members are not required to complete one unless Summit determines that an induction is necessary for a particular activity or item of equipment.
If you are unsure how to use equipment safely, you must ask a member of staff before using it.
Members must:
a. use equipment only for its intended purpose;
b. follow displayed instructions and reasonable staff directions;
c. use appropriate weights for their ability and experience;
d. wear suitable clothing and footwear;
e. return weights and equipment after use;
f. wipe down equipment after use;
g. avoid behaviour that creates an unnecessary danger to themselves or others;
h. report damaged or unsafe equipment promptly; and
i. not attempt to use equipment that has been marked as unavailable.
EMERGENCIES AND UNSTAFFED ACCESS
Members acknowledge that Summit may be unstaffed when they attend.
In an immediate or life-threatening emergency, members must call 999.
For urgent problems involving the premises or access, where emergency services are not required, members may contact Summit on 07496 736511.
Emergency exits, fire equipment and access routes must not be blocked or interfered with.
MEMBER CONDUCT
Summit is committed to maintaining a welcoming, inclusive and respectful community.
We operate a zero-tolerance approach to:
a. harassment, bullying or intimidation;
b. discriminatory, hateful or abusive conduct;
c. violence, threats or aggressive behaviour;
d. sexual harassment or inappropriate conduct;
e. deliberate damage or misuse of equipment;
f. theft;
g. allowing unauthorised access;
h. training while under the influence of alcohol or illegal drugs; and
i. conduct that places another person’s health, safety or wellbeing at risk.
Members must treat staff, instructors, contractors and other members respectfully.
SUSPENSION AND TERMINATION BY SUMMIT
We may suspend access while investigating suspected misconduct, payment failures, safety concerns or breaches of these Terms.
We may terminate a membership immediately for serious misconduct, violence, harassment, theft, deliberate damage, access-code sharing or behaviour creating a serious safety risk.
For less serious breaches, we may issue a warning and provide a reasonable opportunity to correct the behaviour before terminating membership.
We may also terminate a membership for operational or business reasons by giving reasonable notice and refunding any prepaid amount relating to a period after termination.
A member may be required to pay for deliberate or reckless damage they cause to the premises or equipment, limited to the reasonable cost of repair or replacement.
PERSONAL BELONGINGS
Lockers are not currently provided. Open shelving may be available for temporary use.
Personal belongings must not be left at the gym overnight.
Members remain responsible for their possessions and should avoid bringing valuable items where possible.
Summit is not responsible for loss, theft or damage unless caused by our negligence or where the law does not allow responsibility to be excluded.
PARKING
Parking is available only in permitted areas of Ellesmere Business Park and directly outside Summit’s premises where designated.
Members must not park in front of, block access to, or use spaces allocated to other businesses.
Vehicles and belongings left in vehicles remain at the owner’s risk, except where loss or damage is caused by Summit’s negligence.
Summit may require a vehicle to be moved if it is obstructing access or incorrectly parked.
PHOTOGRAPHY AND FILMING
Members may take photographs or videos for personal use, provided they:
a. respect the privacy of other people;
b. obtain permission before deliberately filming or photographing another person;
c. avoid capturing other members wherever reasonably possible;
d. do not obstruct equipment or create a safety risk; and
e. stop filming if requested by a member of staff or another person who may be recorded.
Commercial filming, organised content production or photography requiring significant space must be approved by Summit in advance.
Summit will obtain appropriate permission before using identifiable member images for advertising or promotional purposes.
CCTV
CCTV operates at the premises for safety, security, crime prevention and the protection of members, staff, visitors and property.
CCTV must not be interfered with, covered or damaged.

CLOSURES AND SERVICE INTERRUPTIONS
We may temporarily restrict or close all or part of the gym for maintenance, repairs, cleaning, emergencies, safety concerns, legal requirements or circumstances outside our reasonable control.
Where reasonably possible, advance notice will be provided.
Short or occasional interruptions will not normally result in a refund. If access is materially unavailable for a prolonged period, we will consider an appropriate extension, credit, refund or cancellation option based on the circumstances and applicable law.
LIABILITY
Exercise and physical activity involve inherent risks. Members are responsible for exercising within their abilities, following instructions and seeking medical advice where appropriate.
Nothing in these Terms excludes or limits Summit’s liability for:
a. death or personal injury caused by our negligence;
b. fraud or fraudulent misrepresentation; or
c. any other liability that cannot legally be excluded or limited.
Nothing in these Terms affects your statutory consumer rights.
PERSONAL INFORMATION
We process personal information in accordance with Summit’s Privacy Policy.
By becoming a member, you understand that operational information, including payment notices, booking confirmations, access messages, closures and safety updates, may be sent to you. These are service communications and are separate from marketing messages.
CHANGES TO THESE TERMS
We may update these Terms to reflect changes in law, safety requirements, insurance, technology, app functionality or the services we provide.
We will provide reasonable notice of any material change that affects an existing member.
Changes will not remove rights already acquired under the law.

Members should raise complaints by emailing [email protected].
Please include your name, contact details and an explanation of the issue. We will aim to acknowledge and investigate complaints within a reasonable period.
GOVERNING LAW
These Terms are governed by the laws of England and Wales.
You may bring legal proceedings in the courts that apply to your place of residence under applicable consumer law.
